Withholding tax on salaries: Article 383 tax table

Withholding tax on salaries receives special and more complex treatment than other concepts. It is calculated using Procedure 1 or Procedure 2 from the Tax Code, and applies the progressive table from Article 383.

Procedure 1 (Article 385 TC):

Applied month by month. The employer calculates the withholding by taking the worker's monthly income, subtracting allowed deductions, and applying the Article 383 table. This is the most common method.

Procedure 2 (Article 386 TC):

Based on a fixed percentage calculated in June and December each year from the previous 12 months' income. This percentage is applied for the following 6 months. It produces more stable withholdings but can result in under- or over-withholding.

How to file and offset withholding tax

The withholding tax applied to you during the year becomes an advance on your income tax. When filing your annual income tax return, you can offset the total withholdings applied against you.

If you are a withholding agent (company or person that withholds):

  • You must file and pay the withholdings monthly using the withholding tax return (Form 350)
  • The filing deadline depends on the last digit of your NIT (generally between the 8th and 21st of the following month)
  • Late filing generates penalties and late payment interest
  • You must issue withholding certificates to payees before March 31 of the following year

If you are the withholding subject (person withheld from):

  • Keep the withholding certificates issued by your payers

Error 1: Not verifying whether the payee files income tax

Withholding rates vary significantly between tax filers and non-filers. For example, in general services the rate is 4% for filers and 6% for non-filers. Applying the incorrect rate can generate penalties for both the withholding agent and the payee.

Error 2: Withholding on the VAT-inclusive amount

Income withholding tax is applied on the value before VAT. It is a common error to calculate it on the total invoice amount including tax. However, VAT withholding (reteIVA) is indeed calculated on the VAT amount itself.

Error 3: Not withholding when required

Every withholding agent is required to withhold when the payment exceeds the minimum base. Failure to do so generates a penalty equal to 100% of the amount not withheld, plus late payment interest.

Error 4: Confusing withholding tax with self-withholding
